The Fitness League Terms of Service
1. Acceptance of Terms
These Terms of Service (“Terms”) govern your use of The Fitness League mobile application, websites, and related services (collectively, the “Services”).
By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services.
If you are under 18, you may only use the Services under the supervision of a parent or legal guardian, who accepts these Terms on your behalf.
By using the Services, you represent that you meet these requirements.
3. Accounts & Security
You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.
Notify us immediately of any unauthorized use.
We are not liable for losses resulting from unauthorized access unless required by law.
4. Health & Safety Disclaimer
Not Medical Advice:
The Services provide fitness and wellness content for informational purposes only. They are not medical care, diagnosis, or treatment. Consult a qualified healthcare professional before starting any new exercise, nutrition, or wellness program.
Assumption of Risk:
By using the Services, you voluntarily assume all risks associated with physical activity. The Fitness League is not responsible for injuries, health issues, or other outcomes from your participation.
5. Subscriptions & Payments
Certain features require a paid subscription. Pricing, billing cycles, and trial periods are disclosed at the time of purchase.
Payments are processed via third-party providers (e.g., App Store, Google Play, Stripe) and are subject to their terms.
Subscriptions automatically renew unless canceled before the renewal date.
You can cancel your subscription through your app store account settings or by contacting support.
Refunds:
Except where required by law or platform rules, all payments are non-refundable.
6. License & Use Rights
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes, subject to these Terms.
You may not:
Copy, modify, or distribute the Services or content
Reverse engineer or attempt to extract source code
Use the Services for unlawful or commercial purposes without our written consent
7. User Content & Community Features
The Services allow you to log workouts, track progress, participate in challenges, and engage with community features such as leaderboards (“User Content”).
By submitting User Content, you:
Grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute it in connection with the Services.
Represent that you own or have rights to your content and that it does not violate third-party rights.
Agree not to post or submit unlawful, harmful, or objectionable material.
Community Visibility
The Fitness League is designed as a social fitness platform. By using the Services, you acknowledge and agree that certain information — including your username, workout progress, trackables, and participation in leaderboards or challenges — will be visible to other users. This visibility is a core function of the Services and cannot be fully opted out of.
You may have limited options to manage how your information appears (e.g., selecting a display name, profile image, or hiding certain non-essential details), but your participation in community features is required in order to use the Services. If you prefer not to share this information, you must not use the Services or may delete your account at any time.
8. Data & Machine Learning
When you use the Services, we collect certain personal and fitness data. As explained in our Privacy Policy:
Personal identifiers (e.g., name, email) can be deleted or anonymized upon request.
We may retain de-identified workout logs and usage data to train and improve our services, including machine learning features.
By using the Services, you consent to this limited retention and anonymization practice.
9. Intellectual Property
The Services, including software, logos, trademarks, and content (other than User Content), are owned by or licensed to The Fitness League and protected by law.
You may not use our intellectual property without prior written consent.
10. Prohibited Conduct
You agree not to:
Use the Services for illegal purposes
Interfere with or disrupt the Services
Transmit malware or harmful code
Misuse community features (e.g., harassment, cheating on leaderboards)
Attempt to gain unauthorized access to accounts or systems
11. Termination
We may suspend or terminate your account at any time for violating these Terms, creating risks, or engaging in misconduct.
You may terminate your account at any time. Certain provisions (e.g., intellectual property, disclaimers, liability limits) survive termination.
12. Disclaimers
The Services are provided “as is” and “as available.” We make no guarantees that they will be error-free, uninterrupted, or meet your expectations. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
13. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, special, or consequential damages (e.g., lost profits).
Our total liability for any claim shall not exceed the amount you paid to use the Services in the 12 months before the claim.
Some jurisdictions do not allow these limits, so they may not apply to you.

You agree to indemnify and hold harmless The Fitness League, its affiliates, and employees against claims, damages, or expenses arising from your:

15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Connecticut, without regard to conflicts of law.
Arbitration / Class Action Waiver (U.S. users):
Any dispute will be resolved by binding arbitration, not in court.
You waive the right to participate in class actions or jury trials.
Arbitration will follow American Arbitration Association rules and occur in Connecticut.
If you live outside the U.S., disputes will follow your local consumer protection laws.
16. Changes to Terms
We may update these Terms occasionally. If updates are material, we will notify you via the App, email, or other means. Continued use of the Services after changes constitutes acceptance.
